1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of capitalwr.com (the "Site"), our online booking system, and the services offered at Capital Wellness & Recovery, LLC ("Studio," "we," "us," or "our"). By accessing the Site, creating an account, booking a session, or visiting the Studio, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.

2. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last updated" date. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the updated Terms.

3. Eligibility & Accounts

You must be at least 18 years old to create an account or book a session independently. Minors may use Services only with the consent and supervision of a parent or legal guardian, who must complete all required waivers on the minor's behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current information and to notify us promptly of any unauthorized use of your account.

4. Booking, Payment & Cancellation

All sessions must be booked in advance through our online booking system. Payment is processed at the time of booking or at check-in, depending on the service. We accept all major credit cards.

Cancellations made at least 24 hours before your scheduled appointment may be rescheduled or cancelled without charge. Cancellations made within 24 hours of the appointment will be charged 50% of the session fee. No-shows will be charged the full session fee.

Late arrivals will not receive an extension of their session time; sessions will end at the originally scheduled time to accommodate the next guest.

5. Memberships

Membership plans are billed monthly on a recurring basis, subject to a minimum 3-month commitment. After the initial term, memberships continue month-to-month until cancelled. Members must provide 30 days' written notice to cancel by emailing info@capitalwr.com. Membership benefits are non-transferable, may not be shared, and credits do not roll over unless otherwise stated in writing.

6. Refund Policy

All session and membership fees are non-refundable except as required by applicable Maryland law. In the event of an extended Studio closure, we will determine appropriate credits or refunds at our discretion.

7. Acceptable Use of the Site

You agree not to use the Site for any unlawful purpose, to misrepresent your identity, to interfere with the Site's operation or security, or to use automated tools (bots, scrapers) to access or extract data from the Site. We reserve the right to suspend or terminate access for any violation of these Terms.

8. Intellectual Property

All content on the Site, including text, images, logos, and design, is the property of Capital Wellness & Recovery, LLC or its licensors and is protected by applicable copyright and trademark laws. You may not copy, reproduce, or distribute any content from the Site without our prior written consent, except for personal, non-commercial use.

9. Photography & Media

By visiting the Studio or participating in any Studio activity, you grant us the right to photograph or record you for use in marketing and promotional materials, unless you notify staff in advance that you do not consent.

10. Health & Medical Disclaimer

Capital Wellness & Recovery is not a medical provider, and our Services are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a physician before using any Service if you have a pre-existing medical condition. Use of all Services is at your own risk, as further described in our Guest Intake Form & Liability Waiver.

11. Limitation of Liability

To the maximum extent permitted by Maryland law, Capital Wellness & Recovery, LLC and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or Services. Our total liability for any claim arising from these Terms will not exceed the amount you paid for the Service giving rise to the claim.

12. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by us, including our booking and payment processors. We are not responsible for the content, privacy practices, or terms of any third-party site.

13. Dispute Resolution

If you have a concern about your experience at the Studio, please contact us first at info@capitalwr.com so we can work to resolve it directly. Any disputes that cannot be resolved informally shall be governed by the laws of the State of Maryland and resolved exclusively in the state or federal courts located in Prince George's County, Maryland.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Liability Waiver and Member Policies, constitute the entire agreement between you and Capital Wellness & Recovery, LLC regarding your use of the Site and Services.
